It is appellants contention that the evidence is insufficient to support the conviction in that the state failed to prove (1) "that the premises in question was not covered by a license or permit issued by the Texas Alcoholic Beverage Commission or the Texas Liquor Control Board," and (2) the state failed to prove that the premises were a place where a permit could legally be secured to sell whiskey.
