Appellant appeals from orders revoking his probation on two felony theft convictions, V.T.C.A. Penal Code Sec. 31.03(a), and sentencing him to two five year prison terms, which run concurrently. On direct appeal, appellant contended the 1981 indictments to which he originally pled guilty were fundamentally defective for failing to allege the elements of theft. The court of appeals agreed, reversed the trial courts judgments and dismissed the indictments. Whetstone v. State, 739 S.W.2d 650 (Tex.App. - Dallas 1987). We granted the States petition for discretionary review to address three issues: whether the court of appeals erred in holding it had jurisdiction to consider this appeal; whether the court of appeals erred in holding the indictments were fundamentally defective; and whether the court of appeals erred in holding the alleged defects were reversible error because the court had no statement of facts by which to perform a harmless error analysis pursuant to Adams v. State, 707 S.W.2d 900 (Tex.Cr.App. 1986). We will reverse the judgment of the court of appeals based on our disposition of the second ground for review.
